The proposals of the Council of the European Union regarding the establishment of a multilateral investment court

The first quarter of 2018 brought interesting decisions of the European Court of Justice and proposals of the European Commission regarding the relationship between international arbitration and European law. From the point of view of the economic security of EU Member States, the Commission's efforts and the ruling of the ECJ in the Achmea case (C-284/16) open a new chapter in regulating relations between Member States in the area of investment protection, but also concern the protection from investors trying to maximize rent-seeking in countries unprepared for aggressive activities of private entities.
